These terms constitute an agreement between you and Chiloonge. (hereinafter referred to as "We") regarding your download, installation, use of the Coloro software, and access to related services provided by the Coloro software. For certain services covered in these terms that may be provided by the Company's affiliates or parent companies, you acknowledge and agree that the contents of such services will be subject to these terms.
"User" refers to all individual users who directly or indirectly obtain and use the Coloro software and related services. Referred to as "user" or "you" in these terms.
Coloro refers to the client application named Coloro that is legally owned and operated by the Company, through which the Company provides image beautification and image generation services to users.
The contents of these terms also include all relevant agreements, rules and other content regarding the Coloro software and related services that have been or may continue to be released by the Company in the future. Once such content is formally released and delivered to the user through appropriate means (such as system notifications), it shall become an indivisible part of these terms, which you shall equally abide by.
Your right to use Coloro is limited to personal use by you only. Your use of the Coloro App is subject to all applicable laws and regulations of states, countries and international law. You agree:
Your subscription or service will auto-renew at the same price and duration as your original subscription package chosen, unless you turn off/cancel its auto-renewal.
Your account will be charged for the renewal within 24 hours before your current subscription ends. So if you do not want to auto-renew the subscription, you will need to cancel it at least 24 hours before the end of your existing subscription period. Please note: We reserve the right to block all users from accessing from that IP address and immediately cancel the access, without further notice, if the account and password are used or abused in any way. Furthermore, you shall be solely responsible for all activities or anything occurring under your account. You agree to notify us immediately of any unauthorized access to your account or any breach of security. We shall not be liable for any loss caused by another person using your username or password, under any circumstances. However, you may be responsible for any loss caused to us or others due to giving your password or account access to others.
Mobile "In-App" Purchases: When you make any in-app purchases from a mobile app store platform, including subscriptions and products, the payment for such purchases may be processed by third parties on our behalf or directly by the mobile app providers like Google Play or Apple iTunes. You can view the applicable rules and policies for "In-App" purchases directly from the mobile app store provider's terms and conditions/agreements.
You will accept full responsibility for the authenticity and accuracy of the information shared by you (including credit card details etc.). You accept and understand that we do not assume any liability or responsibility for any direct, indirect, incidental or consequential loss in any way or hold ourselves responsible, including but not limited to any losses arising out of delayed payment processing instructions or any credit card frauds. Regarding your rights to cancel orders and receive relevant refunds, you must accept and agree to the terms and conditions of the respective mobile app store provider.
You accept and agree that all billing and transaction processing will be handled by the mobile app store provider from where you have downloaded the app or service and bound by the terms and agreements/EULA of the mobile app store provider. In case of any issues related to in-app purchase payments, you should contact the app store provider directly.
The intellectual property rights in the content provided in the Coloro software and related services by the Company (including but not limited to software, technology, programs, web pages, texts, images, audios, videos, charts, layout designs, electronic documents etc.) belong to the Company or relevant parties. The copyright, patents and other intellectual property rights pertaining to the software relied upon by the Company in providing this service also belong to the Company or relevant parties. Without permission from the Company, no one shall use (including but not limited to through any robot, spider or other programs/devices to monitor, copy, distribute, display, mirror, upload, download the contents in the Coloro software and related services) the contents.
The Company develops and operates Coloro, provides technical support for it and owns all rights to all data and information generated during the development and operation processes of Coloro software and related services.
Please do not use any of the Company's trademarks, service marks, trade names, domain names, website names or other distinct brand features (hereinafter referred to as "Identifications") without authorization under any circumstances, including but not limited to Coloro etc. Without prior written consent from the Company, you shall not display, use or apply to register the aforesaid Identifications as trademarks or register domains individually or in combination in any manner, nor shall you conduct any acts implying authorization to display, use or otherwise handle those Identifications to others. You shall bear full legal liability for any losses caused to the Company or others due to your unauthorized use of the Company's aforementioned trademarks, identifications etc. in violation of this agreement.
You agree that you are solely responsible for any content or information you upload or submit, whether privately communicated or publicly posted. You must ensure that any information you provide is accurate and truthful, and that you have the right to provide that data or content.
You shall not publish any content or information that is protected by trademarks and copyrights without any explicit written consent from the owner of that content. You shall be fully responsible for any disputes or copyright infringements resulting from the content or information provided by you.
Please note: When you take videos or upload photos for photo beautification using Coloro, the videos and photos taken and uploaded are only for your photo beautification use on Coloro and will be automatically deleted with the expiration of the validity period of the beautified photo and user deletion operations. Coloro will not collect your facial recognition information.
While some parts of Coloro can be browsed and viewed without prior registration, accessing personalized predictions, detailed analyses, reports and receiving other contents requires registration or login to Coloro.
To register your account with us to avail personalized services, you agree to provide complete and updated information about yourself. Any misleading information could lead to termination of your account.
Coloro reserves the right to take any necessary measures to ensure security of your account and application. This may include changing your password, requesting information about transactions in your account, or even terminating your account.
When you create an account on Coloro, we will provide you with a User ID and Password (if generated by you). You are responsible for maintaining the confidentiality and security of your account credentials. You shall be fully responsible for all activities under your account and agree not to transfer or sell your account to any other party. Further, you agree to immediately notify Coloro of any irregularities in your account, if any.
You also agree that Coloro and its employees or agents may access your account to better serve you or investigate and resolve issues (if any).
Coloro reserves the right to modify or terminate your account or terminate certain services with or without prior notice in following cases:
You provide misleading data or information to us.
We are unable to verify or authenticate any information provided by you.
You violate the user agreement.
Your actions lead us to any legal liability.
The Privacy Policy of Coloro also applies to the Terms of Use. You can view our Privacy Policy by going to "Me-Settings-Privacy Policy".
Coloro may contain links to websites of independent third parties. We assume no responsibility for the content, materials or information posted on these linked sites. Such sites are not under our control. It is entirely your decision to browse and interact with these third party websites. Coloro shall not be responsible under any circumstances for any damage caused to you due to your interaction or association with these websites.
The information on Coloro is obtained from sources believed to be reliable. Coloro makes no warranties or representations as to the accuracy, completeness, or reliability regarding any advice, opinion, statement or other information displayed through the application. You agree that any reliance on any such opinion, advice, statement or information shall be at your sole risk and that Coloro is not liable under any theory of law for your use of Coloro or in connection with Coloro or its content or with any failure, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure, even if Coloro is aware of the possibility of such damages.
In no event shall Coloro be liable for any damages whatsoever, including but not limited to direct, indirect, incidental, consequential, special or punitive damages arising out of the use of or inability to use Coloro or in connection with any failure, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure, even if Coloro is expressly advised of the possibility of such damages, whether under contract, tort or otherwise, or in connection with Coloro or any failure, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure, on the part of Coloro or any content or any third party related to the performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure on the part of Coloro, even if Coloro is aware of the possibility of such damages.
You agree that if we find you violating any of the terms and conditions, Coloro may terminate or restrict your access to Coloro or any other parts of Coloro with or without prior notice.
You agree that if you violate such termination or restriction, you will indemnify us from any liability we may incur. We reserve our right to take legal actions against any violators according to law.
